Janis H. Malan, Esquire

Janis H. MalanDuring her tenure at the University of Baltimore School of Law, Ms. Malan worked full time for a period of time for the Injured Workers' Insurance Fund managing Workers= Compensation claims. Ms. Malan accepted a position with Professor Byron L. Warnken, primarily doing appellate work. For several years, she researched and briefed more than 17 criminal and civil appeals in the Maryland Court of Special Appeals, the Maryland Court of Appeals, the United States Court of Appeals for the Fourth Circuit, and the United States Supreme Court. Of these 17 appellate briefs, 15 of them were decided favorably for Ms. Malan's client.



Ms. Malan then opened her own law firm where for several years she practiced appellate law, criminal law, personal injury, and domestic law. In addition to her extensive trial work, Ms. Malan had the opportunity to brief and argue more than 30 criminal and civil cases on appeal in the Maryland Court of Special Appeals, the Maryland Court of Appeals, and the United States Court of Appeals for the Fourth Circuit.


In 1999, Ms. Malan was asked to join Semmes, Bowen & Semmes, a firm located in downtown Baltimore, Maryland. Ms. Malan was a member of the workers' compensation department, and represented such major corporations as Rite Aid, Walmart, Home Depot, University of Maryland Medical System, AIG Insurance, and the workers and employees of Baltimore City in the defense of workers' compensation claims. During her seven-year tenure with this large 100-year old Baltimore firm, Ms. Malan tried to decision more than 2000 workers' compensation claims before the Baltimore Worker s' Compensation Commission. Additionally, Ms. Malan tried to jury verdict more than 50 workers' compensation appeals in the Circuit Courts of Maryland.

From 2006 to 2008, Ms. Malan worked as in-house counsel for Traveler s Insurance Company as part of the Defense Litigation Group, managing high exposure workers' compensation claims nationwide. Ms. Malan has extensive training in Medicare Set Aside issues involved in workers' compensation settlements and worked with Travelers management team to set up an in-house Medicare Set Aside Consultant program in which the company provides Medicare Set Aside recommendations to its clients during settlement negotiations. Ms. Malan was also instrumental in developing protocols for managing medical issues in catastrophic workers' compensation injury claims, protocols for managing home and vehicle modification issues in cases of catastrophic injury, and protocols for referral and management of workers compensation appeals throughout the entire country. In addition, she has provided instruction on Medicare Set Aside issues to the various Travelers staff counsel offices nationwide and instruction on coverage issues relative to construction claims. Throughout her career, Ms. Malan has developed extensive experience in all facets of personal injury and workers' compensation claims, and not only understands many of the procedures used by insurance companies in handling these matters, but in some instance wrote those protocols.

Janis Malan's legal expertise spans the past 20 years, during which time, she has handled a wide variety of cases involving both criminal and civil issues. Ms. Malan pursued her undergraduate studies at the University of Maryland in College Park, graduating cum laude. In 1990, Ms. Malan entered the University of Baltimore School of Law, and graduated in the top ten percent of her class in 1993.

In 2009, DeLeonardo, Smith & Associates was fortunate to recruit Ms. Malan, and now her wealth of experience in handling significant personal injury and workers' compensation matters for major corporations and insurance companies is now utilized for the benefit of the Firm's clients.

Ms. Malan is admitted to practice before the Maryland Workers= Compensation Commission, the Maryland State court, the Maryland Courts of Appeal, the United State=s District Court for the District of Maryland, the United State=s Court of Appeal for the Fourth Circuit, and the United State=s Supreme Court.
